1. Introduction
EziPay SL is a licensed digital financial services provider based in Sierra Leone, committed to delivering secure, fast, and transparent payment solutions for individuals, businesses, and diaspora communities. Operated by Ezeepay SL Limited, a private company duly incorporated under Sierra Leonean law and licensed by the Bank of Sierra Leone, these Terms govern your use of the EziPay SL platform and mobile application.
By accessing or using EziPay SL services, you agree to be bound by these Terms and Conditions. If you do not accept these Terms, you must not use our services.
2. Definitions
For the purpose of these Terms:
“EziPay SL” or “We/Us” means Ezeepay SL Limited.
“User” or “You” means the person who registers for and uses EziPay SL services.
“Platform” refers to the EziPay SL mobile application, website, and related digital channels.
“Transaction” means any transfer, payment, top-up, or service request initiated via EziPay SL.
“Third-Party Providers” refers to external companies (e.g., banks, telecom operators, utility providers) that deliver services through the EziPay SL platform.
3. Services Provided
Through its platform and mobile app, EziPay SL currently provides (but is not limited to) the following services:
- Domestic money transfers within Sierra Leone.
- International inward remittances from abroad to Sierra Leone.
- Electricity bill top-ups (EDSA).
- Digital payments for goods and services.
- Airtime purchases for Orange and Africell networks.
- Transfers via partner mobile money networks (Afrimoney, Orange Money).
- Sea Coach ticket bookings.
Service availability may vary by region and is subject to third-party provider constraints.
4. Eligibility and Account Registration
- Users must be at least 18 years old and legally capable of entering binding contracts.
- You must provide truthful, accurate, and complete information during registration.
- Only one account per person is permitted.
- You are responsible for safeguarding login credentials and must notify EziPay SL immediately of any unauthorized use.
5. User Responsibilities
- Use the platform for lawful purposes only.
- Provide accurate transaction and recipient details.
- Pay all fees and charges applicable to your transactions.
- Cooperate with AML and KYC requirements, including providing valid identification or proof of funds when requested.
- Safeguard your account and avoid sharing your credentials.
- Immediately report any suspicious, unauthorized, or fraudulent activity on your account.
6. Fees and Charges
- All applicable fees for transfers, payments, and third-party services will be disclosed prior to confirmation.
- Fees may change from time to time with prior notice.
- By proceeding with a transaction, you agree to pay all applicable charges.
7. Payment Processing and Transaction Times
- Transactions are subject to verification and processing times from banks, mobile networks, and third-party providers.
- Estimated delivery times are for guidance only and not guaranteed.
- EziPay SL is not liable for delays caused by third parties.
8. Refunds and Cancellations
- Refunds are permitted only if the funds have not yet been delivered to the recipient.
- Transaction fees are non-refundable, except where EziPay SL is at fault.
- Refunds for services such as ticket bookings or utility top-ups follow the third-party provider’s refund policies.
- Refunds will only be made to the original funding source, not in cash.
- Refund requests must be submitted within 24 hours of the transaction.
- EziPay SL may deduct administrative charges where applicable.
9. Privacy and Data Protection
- Personal data is collected, processed, and protected as described in the EziPay SL Privacy Policy.
- By using our services, you consent to the collection and processing of your data for service delivery, regulatory compliance, and fraud prevention.
- EziPay SL follows best international practices, including principles aligned with GDPR, to protect customer data.
- While industry-standard security measures are applied, absolute protection against internet risks cannot be guaranteed.
10. Anti-Money Laundering (AML) and Compliance
- EziPay SL complies with all AML and Counter-Terrorist Financing (CTF) laws.
- Users may be required to submit additional documentation to verify identity, source of funds, or nature of transactions.
- Suspicious accounts or transactions may be delayed, blocked, reported to authorities, or terminated without notice.
11. Fraud Prevention and Security
- Users must secure their accounts against unauthorized use.
- EziPay SL may implement fraud-prevention tools such as transaction limits and monitoring.
- Any use of the platform for fraud, identity theft, hacking, or unauthorized purposes is strictly prohibited.
12. Intellectual Property
- All software, logos, trademarks, and platform content belong to or are licensed by EziPay SL.
- Users are granted a limited, non-exclusive license to use the platform in line with these Terms.
- You may not copy, reverse-engineer, or distribute any part of the platform.
13. Liability and Indemnity
- EziPay SL is not liable for indirect, incidental, consequential, or punitive damages.
- We are not responsible for user errors, such as incorrect recipient details or exchange rate fluctuations.
- Our maximum liability is limited to the fees paid for the affected transaction.
- You agree to indemnify EziPay SL against losses arising from your breach of these Terms or unlawful use of the service.
14. Third-Party Services
- EziPay SL partners with third-party providers (e.g., telecoms, utilities, transport companies).
- We are not responsible for failures, delays, or inaccuracies arising from such providers.
- Use of third-party services is subject to their own terms and conditions, which you agree to accept.
15. Service Suspension and Termination
- EziPay SL may suspend or terminate accounts due to non-compliance, fraudulent activity, or regulatory requirements.
- Notice will be provided where possible, but urgent suspensions may occur without notice.
- Funds in suspended accounts will be handled in accordance with regulatory requirements.
16. Complaints and Disputes
- Complaints should be directed to EziPay SL Customer Service at support@ezipaysl.com.
- We will investigate and respond promptly, with acknowledgments and timelines.
- If unresolved, disputes may be referred to the Bank of Sierra Leone or other relevant regulatory authorities.
17. Force Majeure
- EziPay SL shall not be liable for delays or failures caused by events beyond its control, including but not limited to natural disasters, strikes, government actions, internet disruptions, or third-party system failures.
18. Changes to Terms
- EziPay SL may update these Terms from time to time.
- Material changes will be communicated via our website or direct notification.
- Continued use of our services after changes indicates your acceptance.
19. Governing Law and Jurisdiction
- These Terms are governed by the laws of Sierra Leone.
- All disputes are subject to the exclusive jurisdiction of Sierra Leone courts.
